1. Introduction

Welcome to EveeShare ("EveeShare," "we," "our," or "us"). EveeShare is a platform that connects electric vehicle (EV) drivers with hosts who make their residential or commercial EV chargers available for temporary use. By accessing or using our mobile application, website, or associated services (collectively, the "Platform"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms apply to both:

  • Drivers using chargers, and
  • Hosts listing their chargers.

You are responsible for reading these Terms carefully.

EveeShare is currently piloting in Santa Monica, with plans to expand to additional regions. The app is available for download across the United States. These Terms apply to all users, regardless of location. Certain features, fees, or legal obligations may vary depending on your location and the availability of chargers in your area.

2. Eligibility

To use EveeShare, you must:

  • Be at least 18 years old.
  • Have the legal capacity to enter into a binding contract.
  • For hosts: own or have legal permission to share the charger.
  • For drivers: possess a valid payment method and operate your vehicle safely.

We may suspend or terminate accounts that violate these Terms.

3. Nature of the Service

EveeShare provides a technology platform that facilitates agreements between Drivers and Hosts. We do not own, operate, or control the EV chargers listed on our Platform.

EveeShare:

  • Is not a utility provider.
  • Is not responsible for electricity quality, power delivery, or charger uptime.
  • Does not guarantee availability of any charger.

All charging sessions are private agreements between Hosts and Drivers, with EveeShare acting solely as a facilitator.

4. Account Registration

You must create an account to use the Platform. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • Ensuring all information is accurate and up‑to‑date
  • Not sharing your account with others

We may request additional verification information.

4.1 Driver Identity Verification

Drivers may be required to verify their identity before starting a booking or charging session. Identity verification may include, but is not limited to, submission of government-issued identification documents, selfies, or similar information as requested by EveeShare.

Identity verification may be handled by third-party identity verification providers. By using the Platform, you consent to the collection, processing, and verification of your identity information by such third-party providers in accordance with their privacy policies and applicable law.

EveeShare does not guarantee the accuracy or authenticity of identity verification results. Identity verification is a risk-reduction measure only and does not constitute a safety guarantee or warranty of any kind. EveeShare does not store or control identity documents unless required by law or as necessary to provide the verification service.

Failure to complete or pass identity verification may result in delayed, cancelled, or blocked bookings. EveeShare may restrict or suspend accounts if verification fails or if suspicious activity is detected. EveeShare reserves the right to require identity verification at any time, including after account creation or during active use of the Platform.

5. Payments and Fees

5.1 Driver Payments

Drivers agree to pay:

  • The Host's listed hourly rate (based on session duration)
  • A platform/service fee
  • A transaction fee
  • Applicable sales tax (where required by law)

Drivers authorize EveeShare to charge their payment method for all fees.

5.2 Host Earnings

Hosts receive earnings after applicable fees and commissions are deducted.

Hosts acknowledge that:

  • Payouts may be delayed by Stripe or banking partners
  • Refunds may affect future payouts
  • Negative balances may result in withheld or reversed payouts

Unclaimed Earnings Policy

To get paid, hosts need to finish their Stripe account setup, including identity verification and adding a payout method. Your earnings stay in "Pending" until this is done.

You have 90 days to finish setup

Whenever you earn money on EveeShare—whether from a charging session, no-show fee, or cancellation fee—you have 90 days to complete your Stripe verification.

If you finish setup within that time, we transfer your earnings normally during the weekly payout cycle.

What happens if you don't finish setup?

If you don't verify your Stripe account within 90 days:

  • The earnings expire, and
  • They cannot be paid out after that period

This is required by Stripe's rules and banking regulations, not just EveeShare policy.

If your account is restricted

If Stripe flags or restricts your account (identity check failed, payout method invalid, compliance review, etc.):

  • We will hold your earnings for up to 90 days while you fix the issue
  • If it isn't resolved within 90 days, the earnings expire
We may send reminders — but it's your responsibility

We try to notify you, but reminders aren't guaranteed. The 90-day window does not extend if you miss a notification.

Why this exists

This helps us stay compliant with financial regulations, prevents fraud, and keeps payouts running smoothly for all hosts.

5.3 Refunds

Refunds are issued by EveeShare at our discretion. Hosts may be financially responsible for refunds resulting from:

  • Charger malfunction
  • Incorrect listing information
  • Host no‑show
  • Unsafe or unusable charger conditions

EveeShare may deduct refund amounts from future Host payouts.

5.4 Authorization Holds

Before the start of a charging session, EveeShare may place a temporary authorization hold on the payment method you provide. The authorization hold is not a charge, but it may appear as a pending transaction on your account. The hold amount may exceed the final cost of your charging session to ensure sufficient funds are available to cover usage, fees, or adjustments.

Once the session ends, EveeShare will capture the actual amount owed based on energy consumed and applicable fees, and any unused portion of the authorization hold will be released. The timing of the release is determined by your bank or payment provider, and EveeShare is not responsible for delays in the reversal of pending holds.

By using EveeShare, you authorize the platform to place, modify, and release authorization holds as necessary to facilitate payments.

5.5 Authorization for Additional Charges

By creating an account and using EveeShare, you authorize EveeShare to charge your saved payment method for any amounts you incur through your use of the platform. This includes, but is not limited to:

  • No-show fees
  • Late cancellation fees
  • Adjustments based on actual charging session usage
  • Administrative fees or penalties related to misuse of the platform
  • Charges resulting from damages, improper use of a host's equipment, or violations of the Host's rules
  • Any other fees disclosed at the time of booking or in these Terms

You acknowledge and agree that certain charges may be assessed after your booking has ended. These include fees reported by the Host, fees determined by EveeShare after reviewing a session, or adjustments required to correct underpayments or billing errors.

You authorize EveeShare to initiate off-session charges, meaning charges may occur without your active involvement, using your default payment method on file. You understand that failure to pay such amounts may result in account suspension, collection efforts, or other actions permitted by law.

If you believe a charge was made in error, you must notify EveeShare within 7 days so we can investigate and resolve the issue.

5.6 Currency and Taxes

Prices, fees, and payouts are displayed in the local currency applicable to your location (USD or CAD). Currency conversion, if applicable, is handled by our payment processor.

EveeShare does not provide tax advice. Hosts are solely responsible for determining, collecting, reporting, and remitting any applicable taxes, including but not limited to sales tax, GST, HST, PST, VAT, or similar taxes required by law.

EveeShare may collect and remit certain taxes or fees where required by law or payment processors, but unless explicitly stated, hosts remain responsible for their own tax obligations.

6. Booking and Cancellation Policy

6.1 Driver Cancellations

Drivers may cancel according to the cancellation rules provided in the app. Late cancellations or no‑shows may incur fees.

6.2 Host Cancellations

Hosts must honor accepted bookings. Excessive cancellations may result in account suspension.

6.3 No‑Shows

If a Driver does not arrive or begin charging, the session may be automatically marked as a no‑show. Fees may apply to compensate Hosts.

7. Charging Sessions

Drivers must:

  • Use chargers safely
  • Report issues immediately
  • Disconnect and vacate the charging spot when the session ends

Hosts must:

  • Ensure the charger is accessible
  • Maintain safe conditions around the charger
  • Immediately inform EveeShare of downtime or issues

EveeShare is not responsible for:

  • Property damage
  • Electrical issues or charging failures
  • Personal injury

8. Host Responsibilities

Hosts agree to:

  • Provide accurate charger details
  • Maintain legal right to share the charger
  • Ensure compliance with local laws, HOA rules, and utility policies
  • Comply with all applicable local, provincial, state, and federal laws, including tax and utility regulations
  • Maintain liability insurance appropriate for hosting

Hosts assume all liability related to:

  • Their property
  • Their charger equipment
  • Any incidents that occur on their premises

8.1 Host Requirements

Hosts are only required to provide access to the charger or outlet listed in their reservation. Access to restrooms, indoor spaces, Wi-Fi, or any other amenities is entirely optional and up to the Host's discretion. Hosts are not required to own an electric vehicle to list their charger or outlet on the platform.

8.2 Security Cameras and Recording Devices

Hosts are allowed—and encouraged—to have cameras and other recording devices on their property for safety and security purposes. However, cameras or recording devices are strictly prohibited in any restrooms available to Guests. Hosts must comply with all applicable local, state, provincial, and federal laws regarding recording devices and privacy.

By using the Platform, Drivers acknowledge and consent that Hosts may have security cameras or recording devices on their property, except in restrooms, and that such devices may record activity during charging sessions.

9. Driver Responsibilities

Drivers agree to:

  • Respect host property
  • Follow charging instructions
  • Not damage equipment or block access
  • Pay for all completed and active sessions

Drivers assume all liability related to:

  • Their vehicle
  • Parking and maneuvering on Host property

10. Safety and Conduct

Users agree not to:

  • Engage in harassment or abusive behavior
  • Damage chargers or property
  • Use the platform for unlawful purposes
  • Tamper with chargers or electrical infrastructure

EveeShare may ban users who violate these rules.

11. Platform Limitations

EveeShare does not guarantee:

  • Continuous uptime of the app
  • Charger availability
  • Accurate energy measurement
  • Accurate real‑time session details if connection is lost
  • Availability of hosts, chargers, or features in all geographic regions

The Platform may experience outages, delays, or bugs.

12. Liability Disclaimer

To the fullest extent permitted by law:

  • EveeShare is not liable for damages related to charging sessions, property damage, injury, fire, or electrical faults
  • EveeShare is not liable for lost income or business interruption
  • EveeShare's total liability is limited to the fees paid by the user during the past 12 months

Hosts and Drivers agree to hold EveeShare harmless from all claims arising from their actions.

13. Insurance

EveeShare does not provide insurance to Hosts or Drivers. It is the responsibility of:

  • Hosts to maintain property liability insurance
  • Drivers to maintain vehicle and personal insurance

14. Privacy

Your data is handled according to our Privacy Policy. You consent to:

  • Payment processing through third‑party providers like Stripe
  • Communication through push notifications, email, and SMS
  • Data collection for security, analytics, and service improvement

15. Termination

EveeShare may suspend or terminate accounts at any time for:

  • Violations of these Terms
  • Fraud or suspected fraud
  • Chargebacks
  • Safety concerns

Users may delete their account at any time.

16. Dispute Resolution

Disputes will be resolved through binding arbitration, not in court, except for small claims. Users waive the right to participate in class‑action lawsuits.

17. Changes to Terms

We may update these Terms at any time. Continued use of the Platform indicates acceptance of the updated Terms.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which EveeShare is incorporated, without regard to conflict of law principles. Users agree that disputes will be resolved in accordance with Section 16 (Dispute Resolution), regardless of their country of residence.
